1. Introduction Welcome to GetDates.ai. These Terms of Service explain the rules for using our website, app, AI photo generation tools, free previews, paid unlocks, and related services. By using GetDates.ai, you agree to these Terms. If you do not agree, do not use the Service. GetDates.ai helps users create AI-generated dating and profile photos. We are not a dating app, matchmaking service, or relationship advisor, and we do not guarantee matches, dates, messages, or any specific outcome on any platform. 2. Eligibility You may use GetDates.ai only if: - You are at least 18 years old and the legal age of majority where you live. - You can legally agree to these Terms. - Your use of the Service is lawful in your location. - You will not upload, generate, request, or share images involving anyone under 18. We may suspend or terminate access if we believe the Service is being used unlawfully, harmfully, or in violation of these Terms. 3. Your Account You are responsible for your account, login credentials, uploaded photos, generated photos, prompts, purchases, and all activity under your account. You agree to provide accurate information, keep your account secure, and tell us promptly if you believe your account has been accessed without permission. 4. Uploaded Photos, Consent, and AI Processing To generate photos, you upload selfies or other reference photos. These photos may include your face, likeness, and other personal information. Some laws may treat facial images, likeness data, or related processing as sensitive, biometric, or special category data. By uploading photos, you confirm and agree that: - The photos are of you, or you have express permission from the person shown in the photos. - Every person shown in the uploaded photos is at least 18 years old. - You have all rights, permissions, and consents needed to upload the photos and use them for AI photo generation. - You consent to GetDates.ai processing the photos to provide the Service. - You consent to GetDates.ai sending the photos, prompts, and related inputs to OpenAI so OpenAI's image model can generate new images using the uploaded photos as identity reference inputs. - You understand that generated images may resemble the uploaded person and may not be perfect, unique, or suitable for every use. We do not train a per-user model on your selfies. We do not use your selfies to train our own AI models. Based on OpenAI's API terms and data-use commitments for business/API services, OpenAI does not use API customer content to train or improve its models unless the API customer explicitly agrees to that use. 5. How the AI Photo Service Works GetDates.ai currently uses OpenAI's image model, including the Images Edit API, to generate photos. Your uploaded selfies may be sent to OpenAI at generation time as identity references. Generated photos are then stored by GetDates.ai. Uploaded selfies and generated photos are stored in a private Google Cloud Storage bucket. They are not posted publicly by default. We do not publish your generated photos, sell them, or use them in marketing without your permission. AI generation can fail, be delayed, be refused by safety systems, or produce results that do not match your expectations. We may reject, remove, or decline to generate content that violates these Terms, law, platform policies, or provider rules. 6. Free Previews and Paid Unlocks GetDates.ai uses a freemium model. You may generate a limited number of photos for free (currently up to 15 in any rolling 24-hour period; we may adjust this limit). Free photos are shown as watermarked, downscaled previews. Free previews are provided so you can decide whether you like the results before paying. To download clean, full-resolution, watermark-free photos, you must make a one-time purchase. Current paid unlock options are: - $9 for 1 photo - $29 for 100 photos - $99 for 500 photos These are one-time payments for digital goods or digital unlock credits. They are not subscriptions. There is no recurring billing for current public purchase options. Prices are in USD unless stated otherwise. Taxes may be added where required. We may change prices or packages in the future, but price changes will not affect purchases you already completed. 7. Payments Payments are processed by Stripe. We do not store your full payment card number. Stripe may process your payment information under its own terms and privacy policy. A purchase gives your account the applicable number of photo credits. One credit delivers one clean, full-resolution, watermark-free generated photo, unless the checkout page states otherwise. Credits can be spent in two ways: unlocking a photo you already generated as a free preview, or creating a new photo in the studio (studio photos are delivered clean and unlocked, and spend one credit each at creation). Unlock credits are not cash, have no stored monetary value outside the Service, are not transferable, and may not be resold. 8. Refunds and Digital Goods Because free watermarked previews are available before purchase, paid unlocks and download credits are generally final and non-refundable once delivered, used, unlocked, or downloaded. We may provide a refund or replacement at our discretion if: - You were charged twice by mistake. - A payment was unauthorized. - We fail to deliver the purchased unlock credits. - A technical issue prevents access to a paid clean download and we cannot fix it. We do not provide refunds because generated photos did not lead to more dating app matches, because you changed your mind after purchase, or because you dislike a result that was visible as a free preview before payment. Nothing in this refund policy limits any non-waivable consumer rights you may have. If you are in the EU, UK, or another jurisdiction with mandatory digital content cancellation rights, you agree that paid digital content may be supplied immediately after purchase, and you acknowledge that any withdrawal right may be lost once delivery begins, to the extent permitted by law. 9. Ownership and Licenses You keep your rights in the photos and other content you upload. As between you and GetDates.ai, you may use unlocked generated photos for your own lawful personal, dating, social, professional, and personal-commercial profile uses, including dating apps, social profiles, portfolio pages, creator profiles, and similar uses connected to you or the person who authorized the photos. To the extent GetDates.ai has any rights in unlocked generated photos, we assign or license those rights to you so you can use the unlocked photos as described above. Important limits: - Free watermarked previews are licensed only for viewing and evaluation inside the Service. You may not remove, hide, crop out, or bypass the watermark. - AI outputs may not be unique. Other users may receive similar outputs. - We cannot guarantee that an AI-generated image is copyrightable or that you will have exclusive rights in it. - You are responsible for checking whether your use of generated images complies with dating app rules, advertising rules, platform policies, and applicable law. - You must not use generated images to impersonate someone, falsely imply endorsement, mislead others about your identity, or deceive people in a harmful way. 10. License You Give GetDates.ai You grant GetDates.ai a limited, worldwide license to host, store, process, reproduce, resize, transmit, and display your uploaded photos, prompts, generated previews, and generated photos only as needed to: - Provide and operate the Service. - Generate, store, preview, unlock, and deliver photos. - Provide support and troubleshoot issues. - Detect abuse, fraud, security incidents, or legal violations. - Comply with law. - Create de-identified or aggregate analytics that do not identify you. We do not use your uploaded selfies or generated photos for public marketing without your consent. We do not sell your personal data. 11. Our Intellectual Property GetDates.ai, including our website, software, design, branding, prompts, workflows, text, graphics, logos, and other materials, belongs to us or our licensors. You may not copy, modify, reverse engineer, scrape, resell, or misuse the Service except as allowed by these Terms or applicable law. 12. Acceptable Use You agree not to use GetDates.ai to: - Upload photos of another person without permission. - Upload or generate images of minors. - Create deepfakes or synthetic images of non-consenting people. - Impersonate, harass, exploit, threaten, defame, or deceive anyone. - Create sexual, nude, exploitative, abusive, hateful, violent, or illegal content. - Create content for fraud, scams, identity theft, catfishing, blackmail, stalking, or unlawful surveillance. - Misrepresent your age, identity, or appearance in a way that is unlawful or harmful. - Violate dating app rules or platform policies. - Upload content that infringes copyright, trademark, privacy, publicity, or other rights. - Interfere with, overload, scrape, reverse engineer, or bypass security limits of the Service. - Use the Service in violation of OpenAI, Stripe, Google Cloud, or other provider policies that apply to our Service. We may remove content, block generation, suspend accounts, limit usage, or report conduct to authorities where appropriate. 13. Privacy and Data Deletion Our Privacy Policy explains what personal data we collect, how we use it, who processes it for us, and how to request access, deletion, or correction. You may request deletion of uploaded selfies and generated photos by contacting support@getdates.ai or using available deletion tools in the Service. Deletion may not affect information we must keep for legal, security, accounting, fraud prevention, dispute, or compliance reasons. 14. Service Changes and Availability We may change, limit, suspend, or discontinue features, models, pricing, free limits, storage limits, or the Service itself. We will try to avoid disrupting paid access unfairly, but we cannot guarantee the Service will be available forever. If we discontinue the Service, your license to use photos you already unlocked and downloaded will continue, subject to these Terms. 15. Disclaimers The Service is provided "as is" and "as available." We do not guarantee that: - Generated photos will look exactly like you. - Generated photos will be error-free, realistic, unique, or accepted by any dating app. - The Service will improve your dating results. - The Service will be uninterrupted, secure, or always available. - AI outputs will be free from bias, artifacts, inaccuracies, or similarities to other outputs. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing. 16. Limitation of Liability To the fullest extent permitted by law, GetDates.ai and its owners, employees, contractors, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, business interruption, emotional distress, dating app consequences, or harm caused by your use or misuse of generated images. To the fullest extent permitted by law, our total liability for all claims related to the Service will be limited to the greater of: - The amount you paid GetDates.ai in the 12 months before the claim, or - USD $100. Some jurisdictions do not allow certain liability limits, so some limits may not apply to you. 17. Indemnity If you misuse the Service, upload content without rights or consent, violate these Terms, violate law, or cause a claim against GetDates.ai, you agree to indemnify and hold GetDates.ai harmless from resulting claims, damages, losses, costs, and reasonable legal fees, to the extent permitted by law. 18. Governing Law and Disputes These Terms are governed by the laws of the Republic of Estonia, except for mandatory consumer protection laws that cannot be waived. If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer venue rights, you may have the right to bring claims in your country of residence. If you are not a consumer, courts located in Tallinn, Estonia will have exclusive jurisdiction. Where permitted by law, disputes must be brought individually and not as part of a class action, class arbitration, or representative proceeding. 19. Changes to These Terms We may update these Terms from time to time. When we do, we will update the "Last updated" date. If changes are material, we may provide additional notice. Your continued use of the Service after updated Terms take effect means you accept the updated Terms. 20.
